Complaint against Non-Prosecution of a Suspect

If you have filed a report, the Public Prosecution Service decides on the prosecution of the suspect after the police investigation. It may decide not to prosecute the suspect and instead choose a decision of non-prosecution (“sepotbeslissing”). If you have filed a report, you will receive a notification stating that the suspect will not be prosecuted (further). If you disagree, you can initiate a procedure against this decision. The Court of Appeal will then review the case and determine whether it should proceed to trial. The judge will then determine whether the suspect is guilty or not.
